While UK law does not offer a single, unified “personality right,” there are several legal mechanisms available to protect and monetise these assets. Understanding and using these tools effectively is essential for safeguarding your brand and maximising your commercial opportunities.

1. Name, Image, and Likeness Rights (Publicity and Privacy)

Although the EU and the UK do not have standalone ‘rights of personality’, you can still protect your image and identity using:

  • Passing off – to prevent unauthorised commercial use that implies endorsement.
  • Data protection – for misuse of your personal data, including images and videos.
  • Privacy and defamation laws – to protect your personal life and reputation.

To strengthen your protection, you can:

  • Register your name and personal brand as trade marks, particularly for merchandise and endorsements.
  • Ensure all commercial use of your image, name, or likeness is governed by written agreements.

2. Performance and Copyright Rights

As a performer, you may have rights under:

  • Copyright laws, such as the Copyright, Designs and Patents Act 1988 in the UK, which provides performers with performance rights, including control over recordings and broadcasts, and the WIPO Performances and Phonograms Treaty (WPPT) and the European Union's Directive on Copyright in the Digital Single Market.

Licensing allows you to authorise others to use your intellectual property under specific conditions.

  • Use legally binding licence agreements detailing scope, geography, royalties, and duration.
  • Regularly review licensees to ensure proper brand use and alignment with your public image.

5. Digital Rights and Online Protection

Your social media content and digital appearances can be monetised, but also require protection and management.

  • Use copyright and platform-specific tools (like YouTube’s Content ID) to control unauthorised use.
  • Take action against deepfakes, impersonation, or unauthorised NFTs using UK privacy, defamation, or IP laws.

6. Legacy and Posthumous Rights

While there is no specific posthumous publicity right in UK law, your estate can manage your IP through:

  • Copyright and trademark ownership.
  • Wills and estate planning that specify how your brand and IP should be used or inherited.

While UK law doesn’t offer a single comprehensive right for celebrity image or identity, a combination of IP law, contract law, and strategic trademarking provides robust protection. Work with IP lawyers and brand advisors to ensure your rights are secured, monetised, and legally protected for the long term.
