Much copyright is ignored.
Copyright is created all the time. Advances in IT mean that more copyright creation is happening than ever before and that the creative process is being undertaken faster than ever. It is difficult for copyright owners to keep a record of all the copyright assets in their business or under their management.
Traditional methods of securing copyright are out-dated.
Conventional advice is to lodge copyright works with someone that offers a deposit service, such as an IP law firm, a bank manager or a specialist copyright depository.
An alternative approach is to use a date-stamped postal service to send what you have created to yourself and compile an archive of unopened envelopes.
These methods are only viable (at best) for occasional copyright works and they only apply when your work is finished. If you create every day, you need somewhere to deposit your copyright every day. And you should preserve your creative process, not just the copyright in your finished work. If you create on your computer, you need a digital store for your copyright. If you create a lot, you need something that is cost-effective. And, of course, you need something that cannot be tampered with, or stolen, and that provides version control.
Copyright is a right to prevent copying. If you haven’t copied, you haven’t infringed. Evidence of independent creation is a defence to claims that you have infringed someone else’s copyright. But, how will you show this? Proving a negative is difficult. You need a method that is fast, easy and cheap to record your creative process as you go along.
Being able to show how you created a copyright work is key in the modern world. Works created by AI are not protected by copyright. There has to be a satisfactory level of human involvement in the creative process.
In collaborative projects, such as music production (and also scientific research), disputes can arise over the relative contributions of the various contributing parties. Being able to show who did what, and how much, and when, can help to settle, or even avoid, such disputes.
